Triotech Terms of Use

This Terms of Use agreement ("Agreement") governs the use of products and services offered by Triotech, a product-based technology firm providing enterprise-grade software solutions including:

Call Center Systems (Dialers, Speech Analytics)

HRMS (Human Resource Management System)

AI Voice Bots and Automation Platforms

By accessing, installing, subscribing to, or using any Triotech products or services, you accept and agree to be bound by the terms and conditions of this Agreement.

Acceptance of Terms

You acknowledge that you have read, understood, and agreed to these Terms. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization. If you do not agree with any part of these Terms, you must not use Triotech’s Services.

Description of Services

Triotech provides a suite of technology products that include: Cloud-based Dialer Solutions (Predictive, Progressive, Manual) Real-time and Post-call Speech Analytics HRMS software for employee lifecycle management AI-powered Voice Bots for customer engagement Triotech may update, enhance, or modify its Services at its discretion and without prior notice.

User Accounts

You are responsible for: Maintaining the confidentiality of login credentials Ensuring account information is accurate and updated All activity that occurs under your account Unauthorized access must be reported to Triotech immediately.

Permitted Use

You may use the Services solely for legitimate business purposes and in compliance with: Applicable laws and regulations Data privacy and telecommunication laws including but not limited to GDPR, CCPA, HIPAA, and TCPA This Agreement and any product-specific terms or operational policies

Prohibited Activities

You agree not to: Use the Services for illegal or abusive purposes, including robocalling without proper consent Interfere with the functioning, security, or integrity of Triotech’s systems Reverse engineer, copy, or modify the software Upload harmful code or engage in phishing, spoofing, or data scraping Use AI Voice Bot or Speech Analytics outputs for discriminatory decisions or profiling

Data Handling and Privacy

Triotech processes user and customer data in accordance with applicable privacy laws. Triotech commits to: Encrypt data at rest and in transit Enforce access controls based on roles Avoid unauthorized sharing of customer data Store, retain, or delete data based on customer instructions or regulatory requirements Customers are responsible for obtaining proper consents from their end users and employees before using the Services.

Intellectual Property

Triotech retains all ownership rights, including intellectual property rights, to its products, services, trademarks, and content. By using the Services, you are granted a limited, non-exclusive, non-transferable, and revocable license to use the software for your internal business use only. No ownership is transferred. You retain ownership of your data, content, and user-generated input.

Fees and Payments

Use of Triotech’s services may be subject to subscription fees as outlined in your contract or order form. All payments must be made on the agreed billing schedule Fees are non-refundable unless otherwise stated Taxes, levies, and duties are your responsibility Triotech may suspend access in case of delayed or failed payments.

Service Availability

Triotech will strive to provide a service uptime of 99.9% or higher. However, temporary outages may occur due to: Scheduled maintenance Third-party service interruptions Network failures or force majeure events Support is available via standard service channels and based on your service tier.

AI and Automation Ethics

Triotech’s AI services, including Voice Bots and Analytics, are designed to be fair, transparent, and responsible. Customers agree to: Use AI outputs responsibly and not solely for employment, credit, or legal decisions Avoid manipulative or deceptive use of AI bots Ensure proper human fallback mechanisms where applicable Triotech is not liable for decisions made solely based on AI-generated data.

Termination and Suspension

Either party may terminate the use of Services: By giving thirty (30) days’ written notice Immediately upon breach of these Terms Upon termination: Access to Services will be revoked Customer data will be deleted or returned within a defined period Any unpaid dues will become immediately payable Triotech may suspend access for violations or security risks without notice.

Confidentiality

All confidential or proprietary information exchanged between you and Triotech must be protected using reasonable security measures and may not be disclosed to third parties without written consent, except as required by law.

Disclaimer of Warranties

Triotech provides all Services on an “as is” and “as available” basis without warranties of any kind, either express or implied. Triotech does not guarantee that: Services will be error-free or uninterrupted Speech Analytics or AI predictions are 100% accurate Third-party integrations will function without change or issue

Limitation of Liability

To the maximum extent permitted by law, Triotech shall not be liable for: Indirect, incidental, special, or consequential damages Loss of business, profits, data, or goodwill Damages exceeding the total fees paid by you in the twelve (12) months prior to the claim This limitation applies regardless of the legal theory under which liability is claimed.

Third-Party Services

Triotech Services may integrate with or depend on third-party applications. Triotech is not responsible for: Performance or availability of third-party platforms Data handling practices of third-party vendors Terms and policies set by those external services Use of such services is at your own risk.

Modifications to Terms

Triotech reserves the right to modify these Terms at any time. Changes will become effective when posted or communicated to you. Continued use of the Services after modifications constitutes acceptance of the updated Terms.

Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in India.
